Allentown Police Lieutenant Justified In Nightclub Shooting, DA Says

An Allentown police lieutenant was found justified in the shooting of a man armed with a "ghost gun" earlier this year, multiple news outlets say citing a press release from the Lehigh County District Attorney's Office.

Lt. Daniel Gross will face no criminal charges stemming from the June 12 incident near an American Parkway nightclub, according to a statement from Lehigh County District Attorney Jim Martin.

Gross allegedly saw Elyn Jose Martes, 23, engaged in a fight and fire two shots from his Polymer 80 model 9mm semiautomatic pistol, Martin said. 

Gross several times ordered Martes to drop the weapon, a ghost gun. But moments later, the lieutenant saw Martes “postured and appeared about to lift and level the gun,” and fired four shots, LehighValleyLive reports.

Martes -- a member of the "Little Lehigh Crew" -- has since recovered and is scheduled to appear in court on Dec. 8, Meanwhile, Gross has resumed work full-time.
